1. Who we are
We are KA Energetics LLC, a limited liability company registered in Wyoming, United States, doing business as ZeroPoint Earth.
We decide how and why your information is used. Under European and UK data protection law that makes us the "data controller".

2. What this policy covers
This covers what we do with your information when you visit our websites at kaenergetics.com and zeropoint.earth, when you buy from us, and when you take part in our programs, sessions and community.
It goes together with our Terms of Service and our Refund and Cancellation Policy.
Two other companies hold information about you as part of delivering what you bought, and they have their own privacy policies: Kajabi, which runs our checkout and account area, and Mighty Networks, which hosts our community and course.
3. What we collect

4. Health information
We do not ask you about your health. We have no health questionnaire, no medical intake form, and no part of buying from us where you are asked about a condition, a diagnosis or medication.
Sometimes people choose to mention something about their health anyway: on a live call, in the community, or in a message to us. That is always your choice and you never have to.
If you do share something like that:
- We use it only to reply to you and to be useful in the moment
- We do not build a health record or a profile about you
- We never use it for marketing, and we never pass it to advertisers
- We do not share it outside the people on our team who need to see it
One important exception, and please read it. Our community calls are recorded, and the recordings are made available to other members afterwards. If you speak about your health on a community call, that becomes part of a recording other members can watch. Section 5 explains how recordings work and what your choices are.
Please do not send us detailed medical information, and please think before sharing it on a recorded call. We are not medical providers, we do not need it, and we would rather it stayed with the people who do.
If you have shared something and would rather we did not have it, write to care@zeropoint.earth and we will remove it as far as we are able. Section 5 explains what that means for recordings.
Under European and UK law, information about health gets extra protection. Where you have chosen to share it with us, we rely on the permission you gave by choosing to share it for that purpose, and you can withdraw that permission at any time.
5. Recordings
We record things, and it is important you understand what and why.
Community calls
Our live community calls are recorded, and the recordings are kept and made available to other members afterwards. That is part of what community access is, whether you are a Society member or your access came with the course: if you cannot attend live, you can watch later.
This means that if you turn your camera on, speak, or use the chat, that becomes part of a recording other members can watch. It stays available for as long as we keep that recording in the library.
Your choices:
- You can attend with your camera and microphone off and simply watch
- You can leave before any sharing part of the call begins
- You can send a question to us beforehand at care@zeropoint.earth and we will raise it without naming you
- You can watch the recording later instead of attending live
Please be thoughtful about what you share on a recorded call, particularly about your health, other people, or anything you would not want other members to see later.
If you want to be removed from a recording, write to care@zeropoint.earth. We will remove or edit the recording where that is reasonably possible. Please understand that editing a person out of a group video is not always practical, and that other members may already have watched it. We will tell you honestly what we can and cannot do.
One-to-one sessions
One-to-one sessions are recorded automatically, so that the recording is there if you want it afterwards.
We only send it to you if you ask. If you do not ask, nobody else sees it.
We never share it with anyone else and we never use it in marketing.
We keep session recordings for 90 days and then delete them.
You can ask us not to record. Tell us before the session starts, or email care@zeropoint.earth beforehand, and we will turn it off.
What members must not do
Members may not record, screenshot, download or share our calls, or share anything another member said in them. This is in our Terms of Service and it applies to everyone.
6. Why we use your information, and what allows us to
If you are in the EU, the UK or Switzerland, the law requires us to have a specific legal basis for using your information. Here is what we use and why.

We do not make decisions about you by automated means that have a legal or similarly significant effect on you.
7. Who we share it with
We do not sell your information. We never have.
We share it with companies that help us run the business. Each one only gets what it needs and is required to protect it.

We also share information:
- With Skai and our team, where they are involved in working with you
- If the law requires it, for example a court order
- To protect people, if there is a serious risk to someone's safety
- If the business is sold or transferred, in which case we will tell you
- When you ask us to, for example if you agree to us publishing your words
8. Where your information goes
We are based in the United States and we work with people and companies in several countries, including Portugal. Your information may be stored or handled outside the country you live in.
If your information leaves the European Economic Area or the UK, we rely on the legal safeguards available for that, including the standard contractual clauses approved for this purpose, or transfers to countries recognised as providing adequate protection.
If you want to know more about how a particular transfer is protected, write to care@zeropoint.earth and ask.
9. How long we keep it

When we no longer need something, we delete it, make it anonymous, or put it in restricted storage if we have to keep it for legal reasons.
You can ask us to delete your information at any time. See section 10. Sometimes we have to keep certain things, for example transaction records for tax, and we will tell you if that applies.
10. Your rights
Wherever you live, you can:
- See what information we hold about you
- Correct anything wrong or out of date
- Delete your information, subject to anything we have to keep
- Unsubscribe from marketing at any time
- Withdraw permission where you gave it
- Ask us anything about how we handle your information
How to use them
Email care@zeropoint.earth with "Privacy request" in the subject line. Tell us your name, the email address you use with us, what you would like us to do, and which country you live in.
We may need to check it is really you before we act, usually by asking you to reply from the email address on your account.
We reply within 30 days, or 45 days if you are in California, or one month if you are in the EEA or UK. If something is complicated and we need longer, we will tell you why and how much longer.
We will never treat you worse for exercising these rights.
11. If you are in the EEA, the UK or Switzerland
You have these rights under the GDPR and equivalent UK law:

You can complain to a regulator
If you are unhappy with how we have handled your information, you have the right to complain to the data protection authority in your country. You do not have to come to us first, although we would like the chance to put it right.

12. If you are in California
Under California law you can ask us what personal information we have collected about you, where it came from, why we collected it and who we shared it with. You can ask us to delete it or correct it. You can opt out of your information being shared for targeted advertising. You can limit how we use sensitive information. And we cannot treat you worse for asking.

We do not sell your information, but we do share some for advertising
We have never sold your personal information for money, and we do not intend to.
We do use advertising tools on our website, and we may upload email addresses to advertising platforms so they can show our ads to people like our existing customers. This means information such as device identifiers, browsing activity and email addresses reaches companies like Meta and Google.
Under California law that counts as "sharing" for cross-context behavioural advertising, even though no money changes hands. So you have the right to opt out of it, and we want to be straightforward that it happens.
To opt out, use the "Do Not Sell or Share My Personal Information" link in our website footer, or email care@zeropoint.earth with "Do not share" in the subject line. We also respect the Global Privacy Control signal, so if your browser sends one we treat it as an opt-out automatically.
Opting out does not stop you seeing our ads. It stops your information being used to target them.
13. Cookies
Cookies are small files a website puts on your device to remember things about your visit.

If you are in the EU, the UK, or anywhere else requiring it, we ask before setting anything other than essential cookies. You will see a banner the first time you visit, letting you accept everything, reject everything except the essentials, or choose by category. Until you choose, only essential cookies are set.
You can change your mind at any time through the cookie settings on our site, and you can delete or block cookies in your browser settings. If you block them, some parts of the site may not work properly.
14. Children
Our services are for adults. You must be 18 or older to buy from us or take part.
We do not knowingly collect information from anyone under 18. If you believe a child has given us their information, write to care@zeropoint.earth and we will delete it.
15. Keeping your information safe
We take sensible steps to protect your information, and the companies we work with are required to do the same.
Please help by using a strong password, keeping it to yourself, and signing out on shared devices. Tell us straight away if you think someone has got into your account.
No system is completely secure, and we cannot promise that nothing will ever go wrong. If something does happen that puts your information at risk, we will tell you and the relevant authorities where the law requires it.
16. Marketing emails
We only send marketing emails if you have said yes, or if you are already a customer and we are telling you about something similar, which some laws allow. Either way you can stop them at any time.
To stop them, click unsubscribe at the bottom of any marketing email, or write to care@zeropoint.earth. We action it as soon as we can and within a few days at most. You may receive something already scheduled before it takes effect.
Some emails are not marketing and you will still get them while you have an account or a purchase with us: receipts, access details, renewal reminders, security notices, replies to your questions, and changes to these policies.
17. Changes to this policy
If we change this policy we will publish the updated policy here with the date it was last updated.
For changes that materially affect you, we will email you before they take effect.
